Affiliate Program Terms and Conditions

Welcome to the Pushwoosh Affiliate Program. These terms and conditions establish the guidelines for our partnership and set forth the agreement between Pushwoosh ("we" or "us") and you, the Affiliate, in promoting our products and services.

Effective Date: April 25th, 2024

1. DEFINITIONS

   1. "Affiliate" or "You" refers to the individual or entity participating in the Pushwoosh Affiliate Program.
   2. "Pushwoosh" or "We" refers to the company offering the affiliate program.
   3. "Affiliate Program" refers to the program through which affiliates promote Pushwoosh's products or services.
   4. "Commission" refers to the payment to the affiliate for successful referrals or sales.

2. ENROLLMENT

   1. Eligibility: To become an affiliate, you must complete the affiliate application and agree to these Terms and Conditions.
   2. Approval: We reserve the right to accept or reject any affiliate application at our discretion.

3. COMMISSIONS

   1. Earnings: Affiliates will earn a 10% commission on all payments made by clients they refer through the Affiliate Program within the first year of each referred client's initial payment.
   2. Payment: Commissions are paid upon request, and there is no minimum or maximum payout limit. Payments are made in any currency through Wise, and withdrawal fees are the responsibility of the affiliate.

4. AFFILIATE RESPONSIBILITIES

   1. Promotion: Affiliates are expected to promote our products and services in a manner consistent with our brand guidelines and in full compliance with applicable laws and regulations.
   2. Compliance: Affiliates must adhere to all relevant laws and regulations, including anti-spam laws, respect for user privacy, and intellectual property rights.
   3. Ethical Practices: We value ethical marketing and expect affiliates to engage in fair, honest, and transparent practices. Deceptive advertising is strictly prohibited.

5. PROHIBITED ACTIVITIES

   1. Fraud: Affiliates are prohibited from engaging in fraudulent activities like click fraud, cookie stuffing, or incentivized referrals.
   2. Trademark Use: Affiliates are permitted to use Pushwoosh's trademarks and branding materials in a manner that positively promotes Pushwoosh and in direct relation to the Affiliate Program for the duration of this Agreement.
   3. Misrepresentation: Affiliates shall not make false or misleading claims about Pushwoosh or its products.

6. TERMINATION

   1. Rights: Pushwoosh reserves the right to terminate an affiliate's participation if they violate these Terms and Conditions.
   2. Notice: Termination notices will be provided, outlining the reasons for such action. Unpaid commissions may be forfeited upon termination.

7. MODIFICATION OF TERMS

   1. Changes: Pushwoosh may update these Terms and Conditions. Affiliates will be notified of any changes, and continued participation indicates acceptance of new terms.

8. LIMITATION OF LIABILITY

   1. Liability: Pushwoosh is not liable for losses or damages arising from an affiliate's participation in the program.

9. GOVERNING LAW

   1. These Terms and Conditions are governed by the laws of the USA, MD, Kensington.
